Advertising Client Terms & Conditions

Effective Date: January 1, 2026
Last Updated: 2026

These Advertising Terms and Conditions (“Agreement”) govern the purchase and placement of advertising on CourtEngine-powered tournament pages (“Platform”) by any individual, business, or entity (“Advertiser”) who engages CourtEngine for advertising services. By submitting payment, signing an advertising proposal, or otherwise confirming an advertising booking, the Advertiser agrees to be bound by this Agreement in full.

1. Advertising Placement

1.1 Platform Pages

CourtEngine advertising placements appear on digitally hosted tournament pages, including but not limited to live view pages, leaderboard pages, bracket view pages, and standings pages. These pages are publicly accessible to players, spectators, coaches, family members, and other tournament participants during the event period.

1.2 Placement Location

Advertisement banners are displayed in designated zones on platform pages, clearly separated from tournament content. CourtEngine reserves the right to determine the specific size, position, and format of all advertisement placements. Placement specifications will be communicated to the Advertiser prior to campaign launch.

1.3 Event Coverage

Unless otherwise stated in writing, advertising placements are active for the full duration of the tournament event for which the booking is made, from the first day of competition through the conclusion of the final match.

2. Industry Exclusivity

2.1 One Brand Per Industry Category

CourtEngine operates on a strict industry exclusivity policy. Only one advertiser per industry or product category will be accepted for any single tournament event. This policy exists to protect the value and impact of each advertiser’s placement and to prevent competitive conflict within a shared advertising environment.

2.2 Definition of Industry Category

For the purposes of this Agreement, an industry category includes but is not limited to:

  • Sports equipment and paddles
  • Sports apparel and footwear
  • Sports drinks, nutrition, and supplements
  • Food and beverage (non-sports)
  • Sports clinics, physiotherapy, and medical services
  • Gyms and fitness facilities
  • Financial services and insurance
  • Local restaurants and dining
  • Retail and lifestyle
  • Any other category as determined by CourtEngine at its sole discretion

2.3 Multi-Advertiser Tournaments

Multiple advertisers from different industry categories may advertise within the same tournament simultaneously. For example, a paddle brand, a sports drink brand, and a physiotherapy clinic may all hold active placements during the same event without conflict, as each represents a distinct industry category.

2.4 CourtEngine’s Sole Discretion on Category Classification

CourtEngine retains full and final authority to classify any brand or product into an industry category and to determine whether a proposed advertiser conflicts with an existing booking. CourtEngine will make reasonable good-faith efforts to communicate any conflicts to prospective advertisers prior to accepting payment.

2.5 No Guaranteed Exclusivity by Payment Order

Industry exclusivity is not automatically granted on a first-come, first-served basis. CourtEngine evaluates each advertising booking individually and reserves the right to accept or decline any advertiser regardless of the order in which bookings are received or payments are made. If a conflict is identified after payment has been received, the Advertiser will be offered an alternative tournament placement or a full refund of the conflicting booking fee.

2.6 Advertiser Disclosure Obligation

The Advertiser is responsible for accurately disclosing the nature of their business, products, and services at the time of booking. CourtEngine is not liable for any conflicts arising from an Advertiser’s failure to disclose relevant business information. If an Advertiser is found to have misrepresented their industry category, CourtEngine reserves the right to immediately cancel the placement without refund.

3. Booking and Payment

3.1 Booking Confirmation

An advertising booking is considered confirmed only upon receipt of full payment and written confirmation from CourtEngine. Verbal agreements, email inquiries, and proposals do not constitute a confirmed booking.

3.2 Pricing

Advertising rates are based on tournament size as measured by the number of registered players and the scope of the event. Rates are communicated through CourtEngine’s official media kit or advertising proposal. CourtEngine reserves the right to adjust pricing between bookings. Confirmed bookings are not subject to price changes after payment has been received.

3.3 Payment Terms

Full payment is required prior to campaign launch. CourtEngine does not offer installment arrangements unless explicitly agreed in writing. Accepted payment methods will be communicated at the time of booking.

3.4 No Refund Policy

All advertising fees are non-refundable once a booking has been confirmed. By submitting payment, the Advertiser acknowledges and accepts that no refund will be issued for any reason, including but not limited to:

  • Advertiser change of mind or business direction
  • Advertiser dissatisfaction with campaign performance
  • Advertiser failure to provide creative assets on time
  • Tournament postponement or rescheduling (see Section 5.2)

3.5 Season Package Payments

For Advertisers who purchase season or bundle packages covering multiple tournaments, the full package fee is due upon confirmation of the package. Individual tournaments within a package are not refundable on a per-event basis.

4. Creative Assets and Production

4.1 Advertiser-Supplied Creative

Where the Advertiser elects to supply their own creative assets, the following specifications apply:

  • File format: PNG, JPG, or GIF (static or animated)
  • Recommended dimensions: as specified in the CourtEngine advertising specifications sheet provided at booking
  • File size: Maximum 2MB per asset
  • All creative must be delivered to CourtEngine no later than 5 business days before the tournament start date

CourtEngine reserves the right to reject any creative asset that does not meet technical specifications, contains prohibited content (see Section 6), or does not align with CourtEngine’s brand standards.

4.2 CourtEngine Creative Services

Advertisers may engage CourtEngine to design their advertising banner creative for an additional production fee. CourtEngine-designed creative is subject to: a minimum of one (1) revision included in the production fee; additional revisions billed at the applicable hourly rate; final approval from the Advertiser before deployment; and a production lead time of at least 7 business days before the tournament start date.

4.3 Creative Ownership

Where CourtEngine designs the creative assets, CourtEngine retains ownership of the original design files. The Advertiser is granted a non-exclusive, non-transferable license to use the delivered creative assets for the duration of their advertising campaign. Advertiser-supplied creative remains the property of the Advertiser.

4.4 Late Delivery of Creative

If the Advertiser fails to deliver approved creative assets within the required timeframe and CourtEngine is unable to launch the placement on time, no refund or credit will be issued. CourtEngine will make reasonable efforts to launch the placement as soon as possible after receipt of assets.

5. Tournament Events and Campaign Performance

5.1 No Performance Guarantees

CourtEngine does not guarantee any specific number of impressions, clicks, page views, or other performance metrics for any advertising placement. Audience size and engagement are dependent on tournament attendance, player participation, and spectator interest, all of which are outside CourtEngine’s direct control.

5.2 Tournament Postponement or Cancellation

In the event that a tournament is postponed or rescheduled due to circumstances beyond CourtEngine’s control (including but not limited to weather, venue issues, force majeure events, or decisions made by tournament organizers), CourtEngine will make reasonable efforts to transfer the advertising placement to the rescheduled event date at no additional charge. In the event that a tournament is permanently cancelled and cannot be rescheduled, CourtEngine will offer the Advertiser a credit of equal value toward a future CourtEngine advertising placement, or a refund at CourtEngine’s discretion.

5.3 Post-Event Reporting

Where tracking is available, CourtEngine will provide a post-event summary report including total estimated page views and click data associated with the advertising placement. Reports are provided as a courtesy and do not constitute a performance guarantee.

6. Prohibited Advertising Content

6.1 Prohibited Categories

CourtEngine will not accept advertising from the following categories regardless of payment or booking status:

  • Tobacco, cigarettes, vaping, or related products
  • Alcohol (subject to CourtEngine’s discretion for beer or lifestyle brands at appropriate events)
  • Adult content, gambling, or betting services
  • Political campaigns or advocacy organizations
  • Multi-level marketing (MLM) or pyramid schemes
  • Any product, service, or brand that promotes illegal activity
  • Counterfeit goods or brands that infringe on third-party intellectual property

6.2 Content Standards

All advertising content must be accurate, non-misleading, and compliant with applicable Philippine advertising laws and regulations. CourtEngine reserves the right to remove any advertisement at any time if it determines, in its sole discretion, that the content violates these standards or reflects negatively on CourtEngine or the tournament it is associated with.

6.3 Competitor to CourtEngine

CourtEngine will not accept advertising from any platform, software, or service that directly competes with CourtEngine’s tournament management, court booking, or sports event management services.

7. Intellectual Property and Brand Use

7.1 Advertiser Brand Assets

By submitting brand assets (logos, images, copy) to CourtEngine, the Advertiser warrants that it owns or has the right to use all submitted materials and that their use by CourtEngine for the advertising placement does not infringe any third-party intellectual property rights.

7.2 CourtEngine’s Use of Advertiser Brand

CourtEngine may reference the Advertiser’s brand name and logo in CourtEngine marketing materials, case studies, social media posts, and the CourtEngine media kit for the purpose of demonstrating advertising reach and capability, unless the Advertiser provides written objection at the time of booking.

7.3 No Endorsement

CourtEngine’s display of an Advertiser’s brand on its platform pages does not constitute an endorsement of the Advertiser’s products or services by CourtEngine, its staff, or the tournament organizers associated with the event.

8. Liability and Indemnification

8.1 Limitation of Liability

CourtEngine’s total liability to any Advertiser under this Agreement shall not exceed the total advertising fees paid by that Advertiser for the specific campaign in question. CourtEngine is not liable for any indirect, consequential, or incidental damages arising from an advertising placement, including loss of business, loss of revenue, or reputational harm.

8.2 Advertiser Indemnification

The Advertiser agrees to indemnify and hold harmless CourtEngine, its officers, employees, and partners from any claims, losses, damages, or expenses (including legal fees) arising from:

  • The Advertiser’s creative assets infringing third-party intellectual property rights
  • False or misleading advertising claims made in the Advertiser’s creative content
  • The Advertiser’s misrepresentation of their industry category at the time of booking
  • Any claims made by End Users or tournament participants in relation to the Advertiser’s products or services

9. Termination and Removal

9.1 CourtEngine’s Right to Remove

CourtEngine reserves the right to remove any advertising placement at any time without notice if the placement is found to violate this Agreement, applicable law, or CourtEngine’s platform standards. No refund will be issued where removal is due to the Advertiser’s breach of this Agreement.

9.2 Advertiser Cancellation

The Advertiser may not cancel a confirmed booking. All sales are final as outlined in Section 3.4.

10. General Provisions

10.1 Governing Law

This Agreement is governed by the laws of the Republic of the Philippines. Any dispute arising from this Agreement shall be resolved through good-faith negotiation and, if unresolved, submitted to the appropriate Philippine courts.

10.2 Entire Agreement

This Agreement, together with any written advertising proposal or booking confirmation issued by CourtEngine, constitutes the entire agreement between CourtEngine and the Advertiser with respect to advertising services.

10.3 Amendments

CourtEngine reserves the right to update these terms at any time. Existing confirmed bookings are governed by the version of these terms in effect at the time of booking confirmation.

10.4 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions remain in full force and effect.
